Hello, Everyone keeps commercially using my copyrighted artwork without my consent! Don't get me wrong, if someone wants to take pictures of the head for fun, that's great, but if it's for your profit/ benefit you need to contact me, it's only fair. I never signed one release for any use of the copyrighted image of Giganticus Headicus,which is on private property, by the way, yet it's been used in the Zippy the pinhead cartoon strip (June 14, 2006) and copies of it being sold on his website, where he doesn't mention GH, or me, the artist that created it. And he is fully aware of who created Giganticus as I have contacted him & told him how surprised I was to see my creation in his comic strip, and he sent me a letter back "thanking me for creating such a great conversational character for Zippy." But I didn't create it for Zippy, I created it for me.
GH has been used (without my agreement, compensation, or signing a release) in Automobile Magazine (Jan. 2007) in a full page Nissan Infiniti G35 promo shot (page 52) and also on page 31 to promote their photo competition. No one even had the decency to mention Giganticus' name, or the Kozy Corner Trailer Park where it is located. Automobile mag actually seems to imply that GH is in Morgan County Ohio! They just pulled up & started shooting. If my parents hadn't seen them we probably wouldn't have even known they had been there. So my Mom gave them one of my business cards with all my info on it & they mailed me a magazine so I know they had my card still, so there was no reason they couldn't call me and work out an agreement for use of my copyrighted artwork. What recourse do I have? Can I sue? Does anyone know a Copyright Lawyer that wants to make 1/3? My Phone # is (928) 753-9732.
